1. Acceptance of the Terms and Conditions

1.1 By participating in the XeSIM promotion, you fully agree to these Terms and Conditions and confirm that you meet the eligibility requirements set forth herein.

2. Promotion Period

2.1 The promotion period begins on 20/10/2025 and ends on 02/11/2025 (the “Promotion Period”). After this period, the promotion code becomes invalid.

3. Identification of the Organizer

3.1 The organizer is transact Elektronische Zahlungssysteme GmbH, a German company registered under HRB 114 439, located at Fraunhoferstraße 10, 82152 Martinsried, Germany (“Organizer”).

4.1 Participants in the XeSIM promotion must be at least 18 years old, legally competent, and have permanent residence in Germany (“Participants”). Employees of the Organizer or its affiliated companies, as well as their immediate family members or household members, are excluded from participation. Participants may be asked to provide suitable proof of eligibility.

6. Device Compatibility

6.1 This promotion is only compatible with XeSIM profiles on eSIM-enabled devices.

7. Non-Transferability

7.1 The offer is non-transferable, non-exchangeable, and has no cash value.

8. Exclusion of Participants

8.1 The Organizer reserves the right to exclude participants from the XeSIM promotion without providing reasons if they provide false, invalid, inadmissible, fraudulent, or incomplete information, use unauthorized aids, are suspected of manipulation (including but not limited to fraudulent redemptions or automated participation), or otherwise violate these Terms and Conditions. The Organizer may also suspend or terminate the offer under Clause 5 with immediate effect.

9. Personal Use Only

9.1 This offer is intended for personal use only. Resale or distribution of the data or the eSIM is strictly prohibited.

10. Data Protection & Personal Data

10.1 By entering the promotion code to activate the eSIM, users agree to the collection and processing of personal data in accordance with the Organizer’s privacy policy.

11. Intellectual Property Rights

11.1 If a participant submits content, it is subject to the intellectual property rights defined by the Organizer. Participants grant the Organizer a non-exclusive, worldwide, and irrevocable license to use the submitted content for promotional purposes.

12. Limitation of Liability

12.1 To the extent permitted by law, the Organizer is not liable for damages incurred by a participant in connection with participation in the promotion, redemption or use of the offer, or due to technical disruptions, failures, or delays, including but not limited to those caused by network, server, computer, or software issues. This exclusion does not apply in cases where such losses, damages, or injuries are caused by negligence, fraud, or intentional misconduct by the Organizer. Nothing in these Terms and Conditions excludes or limits statutory rights of the participant, including rights under consumer protection laws. 12.2 The above limitations or exclusions of liability do not apply to damages resulting from culpable injury to life, body, or health, or other cases of mandatory statutory liability, particularly under the Product Liability Act. These limitations or exclusions also apply to the Organizer’s agents or assistants directly involved in the promotion.

13. Changes

13.1 The Organizer reserves the right to change or withdraw this offer at any time without prior notice. If the XeSIM promotion cannot be carried out due to fraud, technical failures, or other causes beyond the Organizer’s control that affect the security, fairness, integrity, or proper conduct of the promotion, the Organizer reserves the right to declare the promotion invalid, suspend or cancel it, or amend the Terms and Conditions in whole or in part.

14. Force Majeure

14.1 The Organizer is not liable for failure or delay in fulfilling its obligations under these Terms and Conditions due to circumstances beyond its reasonable control, including but not limited to force majeure, natural disasters, war, unrest, strikes, government actions, pandemics, power outages, or failures of telecommunications or internet services. In such cases, the Organizer reserves the right to suspend, modify, or cancel the promotion without prior notice.
